ORDIN nr. 892 din 2 iunie 2006 privind certificarea conformităţii navelor maritime care arborează pavilion român şi efectuează voiaje interne cu normele tehnice aplicabile EMITENT MINISTERUL TRANSPORTURILOR, CONSTRUCŢIILOR ŞI TURISMULUI Publicat în MONITORUL OFICIAL nr. 526 din 19 iunie 2006 Având în vedere prevederile art. 13 din Ordonanţa Guvernului nr. 19/1997 privind transporturile, republicată, cu modificările şi completările ulterioare, în temeiul art. 7 lit. c) şi o) din Ordonanţa Guvernului nr. 42/1997 privind transportul naval, republicată, şi al art. 5 alin. (4) din Hotărârea Guvernului nr. 412/2004 privind organizarea şi funcţionarea Ministerului Transporturilor, Construcţiilor şi Turismului, cu modificările şi completările ulterioare, ministrul transporturilor, construcţiilor şi turismului emite următorul ordin: + Articolul 1 (1) Prezentul ordin stabileşte măsurile privind inspecţia, supravegherea tehnică şi certificarea conformităţii navelor maritime care arborează pavilion român şi efectuează voiaje interne cu normele tehnice aplicabile. ... (2) Măsurile prevăzute la alin. (1) includ cerinţe privind siguranţa maritimă şi prevenirea poluării marine referitoare la corpul, maşinile şi instalaţiile electrice şi de comandă a navelor. ... + Articolul 2 În înţelesul prezentului ordin, termenii utilizaţi se definesc după cum urmează: a) Autoritatea Navală Română - organul tehnic de specialitate din subordinea Ministerului Transporturilor, Construcţiilor şi Turismului căruia i se deleagă competenţele privind aplicarea prevederilor prezentului ordin, denumită în continuare ANR; ... b) inspecţie şi supraveghere tehnică - inspecţia şi supravegherea tehnică care se realizează în mod obligatoriu în conformitate cu normele tehnice aplicabile; ... c) minister - Ministerul Transporturilor, Construcţiilor şi Turismului; ... d) navă - nava maritimă care arborează pavilionul român şi efectuează voiaje interne; ... e) norme tehnice aplicabile - normele tehnice prevăzute în anexa nr. 1; ... f) voiaj intern - voiajul efectuat în zone maritime între un port românesc şi acelaşi port sau un alt port românesc; ... g) voiaj internaţional - voiajul pe mare efectuat dintr-un port românesc către un port situat în afara României sau invers. ... + Articolul 3 (1) Navele trebuie să îndeplinească normele tehnice aplicabile. ... (2) În cazul în care o navă efectuează un voiaj internaţional ocazional, trebuie să îndeplinească şi cerinţele convenţiilor internaţionale aplicabile în conformitate cu legislaţia naţională în vigoare şi/sau cu acordurile bilaterale aplicabile, potrivit serviciului pe care îl realizează şi caracteristicilor zonei de navigaţie. ... + Articolul 4 Inspecţia, supravegherea tehnică şi certificarea conformităţii navelor cu prevederile normelor tehnice aplicabile se efectuează de către ANR. + Articolul 5 (1) Construcţia, reconstrucţia, modernizarea şi repararea navelor, precum şi a maşinilor, instalaţiilor, echipamentelor şi materialelor pentru acestea trebuie să se realizeze numai în baza unor documentaţii tehnice prin care să se asigure conformitatea cu normele tehnice aplicabile şi sub supravegherea tehnică a ANR. ... (2) Documentaţiile tehnice prevăzute la alin. (1) trebuie avizate de ANR. ... + Articolul 6 (1) Orice navă trebuie să deţină cu certificat de siguranţă a construcţiei şi echipamentelor navei emis de ANR, care atestă faptul că structura corpului, maşinile şi instalaţiile navei sunt adecvate tipului de navă, serviciului şi zonei de navigaţie, conform normelor tehnice aplicabile. ... (2) Forma şi conţinutul Certificatului de siguranţă a construcţiei şi echipamentelor navei sunt prevăzute în anexa nr. 2. ... (3) Certificatul prevăzut la alin. (1) este valabil pentru o perioadă de maximum 5 ani de la data emiterii lui şi se confirmă anual în baza inspecţiilor şi supravegherilor tehnice. ... (4) Valabilitatea certificatului prevăzut la alin. (1) se prelungeşte cu perioade de maximum 5 ani. ... + Articolul 7 (1) Certificatul prevăzut la art. 6 alin. (1) se emite în baza Certificatului pentru mijloace de semnalizare, având forma şi conţinutul prevăzute în anexa nr. 3. ... (2) Certificatul prevăzut la alin. (1) este valabil pentru o perioadă de maximum 5 ani de la data emiterii lui şi se confirmă anual în baza unor inspecţii. ... + Articolul 8 Certificatul de siguranţă a construcţiei şi echipamentelor navei îşi pierde valabilitatea în următoarele cazuri: a) expirarea termenului de valabilitate; ... b) neefectuarea confirmării anuale; ... c) dacă în urma inspecţiilor şi supravegherilor tehnice efectuate se constată că nava nu îndeplineşte cerinţele normelor tehnice aplicabile; ... d) dacă nu s-a solicitat efectuarea unei inspecţii de către ANR imediat după producerea unei coliziuni, unui incendiu sau unui alt eveniment de navigaţie în urma căruia nava a eşuat sau a suferit o avarie la corp, echipamente, maşini, instalaţii ori dotări; ... e) dacă construcţia, reconstrucţia, modernizarea sau repararea navei, precum şi a maşinilor, instalaţiilor şi echipamentelor s-a efectuat fără avizul şi supravegherea tehnică ale ANR; ... f) nerespectarea zonei de navigaţie şi a serviciului prevăzute în certificat; ... g) nerespectarea oricăror alte condiţii de navigaţie şi de transport stabilite prin prezentul ordin sau de către ANR. ... + Articolul 9 ANR va duce la îndeplinire prevederile prezentului ordin. + Articolul 10 Anexele nr. 1-3 fac parte integrantă din prezentul ordin. + Articolul 11 Prezentul ordin se publică în Monitorul Oficial al României, Partea I. Surveyor (Name, Surname, Signature) ────────────────────────────────────────────────────────────────────────────── Prezentul certificat îşi pierde valabilitatea în următoarele cazuri: expirarea termenului de valabilitate; neefectuarea confirmării anuale; dacă urmare inspecţiilor şi supravegherilor tehnice efectuate se constată că nava nu îndeplineşte cerinţele tehnice aplicabile; dacă nu s-a solicitat efectuarea unei inspecţii de către ANR imediat după producerea unei coliziuni, unui incendiu sau unui alt eveniment de navigaţie în urma căruia nava a eşuat sau a suferit o avarie la corp, echipamente, maşini, instalaţii sau dotări; dacă construcţia, reconstrucţia, modernizarea sau repararea navei, precum şi a maşinilor, instalaţiilor şi echipamentelor s-a efectuat fără avizul şi supravegherea tehnică a ANR; nerespectarea zonei de navigaţie şi a serviciului prevăzute în certificat; nerespectarea oricăror condiţii de navigaţie şi de transport stabilite de prezentul ordin sau de către ANR.
